JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 21-06-2016 The object of providing compassionate appointment is well defined. The primary reason being to provide immediate relief to the family due to loss of the bread earner and help the family in distress. It is not a modality to provide employment to otherwise non-employed or unemployable wards of a government servant.
No doubt, death of the father of the petitioner happened on 11.09.2012 but the claim of the present petitioner, who seems to be the third son of the deceased employee, has been rejected primarily on the ground that two brothers of the petitioners are already in government service and are well employed. If the two brothers are not willing to take the responsibility of the mother and other family members, State cannot take responsibility of such family by providing employment to one and all.
The Court is of the opinion that giving any kind of leeway by
Patna High Court CWJC No.16089 of 2014 dt.21-06-2016 interfering with the decision rejecting the claim of the petitioner, contained in Annexure-6, would be doing violence not only to the object of such employment but also to large number of otherwise unemployed youth who have had no privilege of having father or mother working in government service and dying in harness.
No interference is warranted with the decision so taken. Writ application stands dismissed.
