2. The prayed for grant of anticipatory bail to Petitioner Nos. 2 and 3 has already been dismissed as withdrawn vide order dated 25.09.2025.
3. Petitioner No. 1 apprehends his arrest in a case registered for the offence punishable under Sections 341, 323, 308, 504, 506 and 34 of the Indian Penal Code.
4. As per prosecution case, it is alleged that on 12.09.2023 at about 8 PM, all the F.I.R. named accused persons, including this petitioner, abused and assaulted daughter of informant with tangi.

5. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, on account of petty dispute, simple scuffle took place between the parties. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against this petitioner. As per prosecution case, all three F.I.R. named accused persons assaulted daughter of informant, however, as per injury report, doctor found only one injury on the body of daughter of informant which itself falsifies the entire prosecution case. Petitioner claim clean antecedents.
6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
7. Considering the facts and circumstances of the case, general and omnibus nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to Petitioner No. 1 is allowed.
8. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named Petitioner No. 1 be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
