For the Petitioner/s : Mr. Sada Nand Ray For the Opposite Party/s : Mr. Dilip Kumar(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 19-03-2015 Heard both sides.
The petitioners apprehend their arrest in a case under sections 302 and 120/34 of the Indian Penal Code. The informant alleged that the wife of the deceased took the deceased to her house and the informant came to know that his son Chandan Kumar was killed by his wife and in-laws. On such information, the informant and others went to the house of Arjun Das and found the dead body of his son wrapped in sacks.
It is submitted that there is no eye witness to the occurrence. On perusal of the post mortem report it would appear that the deceased committed suicide by hanging himself.
Patna High Court Cr.Misc. No.37643 of 2014 (2) dt.19-03-2015 On perusal of the record, it appears that when the informant went to the house of the petitioners, no body was found there and the dead body was concealed in a sack in the house of the petitioners.
Considering the aforesaid facts, I do not feel inclined to grant anticipatory bail to the petitioners in connection with Maner P.S. Case No. 196 of 2013 pending in the court of Smt. Anupam Kumari, Judicial Magistrate, Danapur. It is, accordingly, rejected.
