JUSTICE MADHURESH PRASAD ORAL ORDER 09-01-2019 I.A.No. 163 of 2019 has been filed by learned counsel for the petitioners with a prayer that the official respondents, namely, the Divisional Commissioner, Tirhut Division, Muzzaffarpur as well as the District Magistrate, Muzaffarpur may be added as party respondents no. 9 and 10 in the cause title of the writ petition. Petitioners want to implead the aforesaid State officials as respondents no.
9 and 10 in view of the developments brought on record by way of counter affidavit wherein stand has been taken that the roster clearance has been taken from the Divisional Commissioner, Tirhut Division; and that the District Magistrate, Muzaffarpur has been requested for considering the case of promotion of petitioners. In view of said development subsequent to filing of the writ petition, no useful purpose would be served by keeping the instant proceedings pending. It is submitted by learned counsel for the petitioners that the newly added respondents no. 9 and 10, i.e., the Divisional Commissioner, Tirhut Division, Muzaffarpur as well as the District Magistrate, Muzaffarpur be directed to merely process the recommendation referred to in the counter affidavit.
In view of the limited prayer, this Court would direct
Patna High Court CWJC No.14085 of 2016(4) dt.09-01-2019 3/3 the newly added respondents, i.e., respondents no. 9 and 10 to ensure expeditious consideration of the petitioners' claim and take a final decision pursuant to the recommendations within a period of three months from the date of receipt/production of a copy of this order.
