====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 31-07-2025 Heard learned counsel for the petitioner and learned counsel appearing for the Bihar State Housing Board.

2. The present writ application has been filed for quashing the letter dated 22.09.2012 issued by the Executive Engineer, Bihar State Housing Board and letter dated 22.08.2014 issued under the signature of the Deputy Revenue Officer, Bihar State Housing Board by which the respondent authorities have directed the petitioner to deposit the dues amount against the flat which has been allotted to the petitioner by the respondent authorities in the city of Gaya. The petitioner

Patna High Court CWJC No.11331 of 2015(15) dt.31-07-2025 2/3 has further prayed for issuance of writ of mandamus for commanding the respondent to execute registered sale deed in favour of the petitioner for the sale of the flat which as per the petitioner has been allotted to the petitioner and the petitioner since then has deposited the entire cost amount of the flat.

Learned counsel appearing for the Bihar State Housing Board submits that before invoking the writ jurisdiction, the petitioner can agitate her grievance before the Pricing committee duly constituted by the Bihar State Housing Board and if he not satisfied with the decision of the Pricing Committee then he can challeng the same by filing a writ application.

4. Learned counsel for the petitioner is prepared to present the case before the Pricing Committee.

5. In view of the above, the present writ application is disposed of directing the petitioner to file a detailed representation before the Pricing Committee constituted by the Bihar State Housing Board within one month from today and if such a representation is filed by the petitioner, the Pricing Committee of the Bihar State Housing Board shall consider the same and decide it on merit after giving full opportunity of hearing to the petitioner. The entire exercise must be completed
