The petitioner, already in custody, seeks bail in connection with Bahera P.S.Case No. 335 of 2016 registered under Sections Section 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016 Allegation in brief is that this petitioner was traveling in a vehicle along with three other co-accused persons and 24 bottles of illicit foreign liquor were recovered from the dicky of the said vehicle and the petitioner was found in drunken condition confirmed by breathe analyzer.

Submission is that this petitioner had taken lift in the vehicle and had no knowledge about the liquor being carried away in the said vehicle and he has no criminal antecedent and has

Having considered the aforesaid facts and circumstances, the petitioner, namely, Sujit Kumar Jha @ Sujit Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/Special Judge, Darbhanga, Bihar in connection with G.O. Excise Case No. 112 of 2016 arising out of Bahera P.S.Case No. 335 of 2016. (Arun Kumar, J) Sujit/- U
