Petitioners by filing aforesaid modification petition have sought one week more time to surrender before the learned lower court modifying the order dated 17.07.2019 of this Court with the case that earlier petitioners along with one other accused namely Okil Paswan were granted anticipatory bail by this Court vide order dated 24.04.2019, but as the aforesaid petitioners could not surrender before the learned lower court within the stipulated period, they filed modification petition.
Patna High Court CR. MISC. No.57154 of 2019(2) dt.11-09-2019 2/2 Same was allowed vide order dated 17.07.2019 and petitioners and one other accused were directed to surrender before the learned lower court and furnish their bail bonds within two weeks from the date of the said order. Complying the same, one co-accused namely Okil Paswan surrendered before the court below, but as the petitioners are working outside the State in connection with their livlihood and learned counsel could not intimate them about the fate of the case and their pairvikar also could not contact the learned counsel, said petitioners could not surrender before the Court below within the stipulated period. Having regard to the facts and circumstances of the case and in the interest of justice, petitioners are directed to surrender before the Court below and furnish their bail bonds within one week from this order.
Accordingly, this modification petition stands disposed of.
