JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-09-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner apprehends his arrest in connection with Supaul P.S. Case No.190 of 2017 registered under Sections 147, 148, 149, 341, 323, 324, 325, 326, 307, 504 and 120(B) of the Indian Penal Code besides Section 27 of the Indian Arms Act, pending in the court of the Additional Chief Judicial Magistrate, Supaul.
Learned counsel appearing on behalf of the petitioner submits that, earlier, the petitioner and Raghu Narayan Yadav alias Raghu Yadav and Pathak Yadav had filed Criminal Misc. No.42204 of 2017 for grant of privilege of pre-arrest bail to them but the same was rejected by this Court on merit vide
Patna High Court CR. MISC. No.60609 of 2019(2) dt.15-09-2021 2/2 order dated 20.09.2017. Thereafter, the police, on investigation, submitted the final form against the petitioner but differing with the final form, the court below took the cognizance of the offence against the petitioner.
Earlier, the prayer of the petitioner along with Raghu Narayan Yadav alias Raghu Yadav and Pathak Yadav for grant of privilege of pre-arrest bail has already been rejected by this Court on merit vide order dated 20.09.2017 passed in Criminal Misc. No.42204 of 2017, as such, I am not inclined to reconsider the prayer of the petitioner for grant of privilege of pre-arrest bail. Accordingly, the prayer of the petitioner for grant of privilege of pre-arrest bail is again rejected. (Rajendra Kumar Mishra, J) P.S./- U T
