The petitioner, who is in custody, seeks bail in connection with Govindpur P.S. case No. 03 of 2017 instituted under Section 30(a) of Bihar Prohibition and Excise Act, 2016. The allegation, in brief, is that he was caught red handed while bringing 30 pouches of country made liquor kept in a gunny bag.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 02.01.2017 and has also got no criminal antecedent except one case registered under Sections 323, 341, 307 and 504 of the Indian Penal Code.

Considering the aforementioned facts and circumstances, the petitioner, named above is directed to be

Patna High Court Cr.Misc. No.6120 of 2017 (2) dt.08-02-2017 2/2 released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Govindpur P.S. case No. 03 of 2017.
