The issue as to non-payment of interest pursuant to the order of the Writ Court dated 20.09.2014 cannot be gone into the present proceeding as there are claim and counter-claim. In view of the above, the present proceeding is
Patna High Court MJC No.1763 of 2015(9) dt.27-03-2019 2/2 dropped. The application stands disposed of with liberty to the petitioner to agitate the factual issue as to delay in payment and non-payment of interest.
In case such dispute is raised by the petitioner before the competent authority, he shall be under obligation to provide hearing to the petitioner and pass a reasoned order within a period of two months from the date of receipt/production of a copy of this order.
