====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence under Section 414 & 120(B) of the Indian Penal Code.

3. On a secret information that some miscreants have assembled to commit crime, a raid was conducted and three motorcycles were recovered on spot, however, the miscreants, after seeing the police party, managed to flee away. The local chowkidar disclosed the name of the persons, who fled away, including this petitioner.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case only on suspicion. No incriminating article has been recovered from the

Patna High Court CR. MISC. No.58875 of 2025(2) dt.15-10-2025 2/2 possession of this petitioner. Similarly situated co-accused Hari Kishore Kumar Yadav has already been granted anticipatory bail by this Court, vide order dated 30.01.2025 passed in Cr.Misc. No. 90009 of 2024. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., East Champaran at Motihari / concerned Court in connection with Chhauradano (Mahuawa) P.S. Case No. 106 of 2024, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
