2. The petitioner is apprehending his arrest in a case in connection with Barhat P.S. Case No. 22 of 2024 dated 21.02.2024 registered for the offences punishable u/ss 365, 306, 201, 211, 182 and 120B read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, the informant's daughter went to the shop and did not return. It is further alleged that the co-accused, Kundan Kumar abducted the informant's daughter with intention to marry her.
4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The
Patna High Court CR. MISC. No.64298 of 2024(8) dt.04-04-2025 2/3 petitioner is not named in the F.I.R. The name of the petitioner has surfaced in this case merely on suspicion. There is no specific allegation against the petitioner. Nothing has been recovered from the possession of the petitioner. There was love affair between the co-accused, Kundan Kumar and the deceased. Learned counsel has further submitted that the the co-accused, Ashok Barnwal in his confessional statement which is mentioned in para 33 of the case diary has stated that due to affair of his daughter with the co-accused, Kundan Kumar, he made objection for illicit relationship of his daughter and tried to stop her. There were frequent arguments at home regarding this matter. On 20.02.
2024, his wife had informed him through phone that his daughter has committed suicide which is also evident in para 24 of the case diary. The co-accused person has already been granted regular bail by this court vide order dated 26.06.2024 passed in Cr. Misc. No. 31719 of 2024. The petitioner has no criminal antecedent as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner and submitted that in the confessional statement of the co-accused, Dr. R. Krishna who disclosed that on the alleged date of the
Patna High Court CR. MISC. No.64298 of 2024(8) dt.04-04-2025 3/3 occurrence, he along with the co-accused, Ashok Barnwal and the petitioner had gone to Sri Krishna Bridge situated at Munger-Khagaria road in order to dispose off the dead body of the deceased.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Jamui in connection with Barhat P.S. Case No. 22 of 2024, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
7. The application stands allowed.
