The petitioner seeks regular bail in connection with L.N.M.U. P.S. Case No. 149 of 2016 registered for the offences punishable under Sections 413, 414, 401, 420, 467 and 468 of the Indian Penal Code.
The informant in course of patrolling duty got information regarding commission of theft of motor-cycle. While some miscreants were fleeing away, one of them was apprehended, who disclosed the name of this petitioner and one Shrawan Ram.
Learned counsel for the petitioner submits that the motor-cycle in question was recovered from the possession of co-accused Gopal Ram. The co-accused Shrawan Ram, whose
Patna High Court Cr.Misc. No.5577 of 2017 (2) dt.07-02-2017 2/2 name appeared in the confessional statement of co-accused Gopal Ram, has been allowed regular bail vide order dated 22.10.2016 in Criminal Miscellaneous No. 46405 of 2016 passed by another co-ordinate Bench of this Court. Learned counsel for the petitioner further submits that the petitioner is in custody since 28.06.2016 and the case of the petitioner stands on similar footing of the co-accused, Sharwan Ram @ Srawan Ram.
Considering the case of the petitioner on similar footing and the facts and circumstances stated above, let the petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with L.N.M.U. P.S. Case No. 149 of 2016.
