The petitioner is in custody in connection with Ghoshi P.S.Case No.370 of 2016 registered for an offence under Section 30 (a) of the Bihar Excise Amendment Act, 2016. In course of search police apprehended few vehicles from which they used to carry foreign liquors. The police recovered 24 litres liquor kept in 44 bottles from a tempo belonging to Diwakar Kumar who disclosed the name of this petitioner as owner of the liquor.

Learned counsel for the petitioner submits that the petitioner has no concern with the alleged recovery and his name appeared in the confessional statement of co-accused Diwakar Kumar and except this nothing has been found against the

Patna High Court Cr.Misc. No.5920 of 2017 (2) dt.15-02-2017 2/2 petitioner. The petitioner is in custody since 02.01.2017. However, learned APP opposed the prayer for bail. Considering the aforesaid facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Jehanabad in connection with Ghosi P.S.Case No.370 of 2016.
