JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code and Sections 30(a)/37 of the Bihar Prohibition and Excise Act, 2016.

Petitioner was apprehended while he was moving after consuming liquor. Thereafter some liquor was recovered from the nearby place.

Submission is that petitioner has stated on oath that he has got no criminal antecedent and is in custody since 30.01.2017.

Considering the facts aforesaid, let petitioner,

Patna High Court Cr.Misc. No.8602 of 2017 (3) dt.10-04-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City, Patna/Successor Court, in connection with Bypass P.S. Case No.17 of 2017, with condition that petitioner shall file undertaking at the time of furnishing of the bail-bond before the Court-below that he would not indulge himself in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
