The petitioner seeks bail in connection with Sessions Trial No.216 of 2016, arising out of Dawath P.S. Case No.101 of 2015, registered under Sections 304(B) and 201/34 of the Indian Penal Code, pending in the court of the 4th Additional Sessions Judge, Rohtas at Sasaram.

The accusation is of killing the deceased, the daughter of the informant, by her husband (petitioner) and other in-laws for non fulfillment of the demand of dowry by pressing her neck and also threw her dead body at the bank of the river. Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.6091 of 2017 (3) dt.06-04-2017 2/2 submits that the petitioner is the husband of the deceased, the daughter of the informant, and has falsely been implicated in this case. The petitioner is in custody since 07.02.2016. On the other hand, learned A.P.P. for the State opposed the prayer of the petitioner for grant of bail with the submission that in the post-mortem examination of the dead body of the deceased, the daughter of the informant, the cause of her death has been shown as asphyxia due to strangulation. Moreover, the dead body of the deceased, the daughter of the informant, was found lying at the bank of the river, near the village of the petitioner. Having regard to the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer of the petitioner for grant of bail stands rejected.
