JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

According to FIR, the petitioner and others dragged to the father-in-law of the informant and took him to maize field from where the informant heard the sound of firing which caused death of the father-in-law of the informant. Evidently, the informant is eye witness of the occurrence and the allegation is of abduction for the purposes of commission of murder which was soon committed, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail in connection with Bihariganj P.S.

Patna High Court Cr.Misc. No.11417 of 2017 (3) dt.19-04-2017 Case No.25 of 2016 pending in the court of Shri P.K. Chaudhary, learned Judicial Magistrate-1st Class, Udakishunganj, Madhepura is rejected.
