JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,406,467,471,386 and 120B of the Indian Penal Code.
The prosecution case is that co accused Arun Yadav got transferred the land of the informant from Ramjhari Devi. The petitioner is alleged to be the identifier and witness of the sale deed.
It is submitted by the learned counsel for the petitioner that two dhoors of land was purchased by co accused Arun Yadav from Ramjhari Devi who happens to be daughter of Bhola Raut
Patna High Court Cr.Misc. No.33613 of 2015 (2) dt.31-08-2015 2/2 and the claim of the informant is that he and his other family members had purchased 9 Katha 18 dhoors of land from sons of Bhola Raut in the year 1980.
Considering the fact that there is no dispute that the daughter of original land holder Bhola Raut from whom Arun purchased the land, had share in the property of father, Arun Yadav has been granted anticipatory bail vide Cr. Misc. No. 8550 of 2015, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, West Champaran in connection with Bettiah Town P.S. Case No.404 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
