Patna High Court CWJC No.20693 of 2021(2) dt.21-12-2021 2/3 For setting aside the E-Auction Sale Notice issued under the signature of authorized officer S.B.I., Dehri-on- Sone dt 19.11.2021 (impugned order) Learned counsel for the respondent Bank states that yesterday the principal borrower has submitted an offer as also submitted a sum of Rs. 2,00,000/-.

In view of the same, the proposed auction, subject matter of challenge in the present petition, has been cancelled.

Patna High Court CWJC No.20693 of 2021(2) dt.21-12-2021 3/3 Only in the event of the principal borrower not adhering to the terms of the settlement or failing to deposit the amount due and payable to the Bank, coercive steps shall be initiated, including releasing the money through the sale of the mortgaged property. Statement accepted and taken on record.

In view of the same, petitioners do not press the present petition, reserving liberty to seek appropriate remedies as are provided in accordance with law, should the need so arise subsequently.

Prayer allowed.

Petition is disposed of as withdrawn with the liberty aforesaid.

Interlocutory application, if any, shall also stand disposed of.
