The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,379,427 and 504/34 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
It is alleged that the accused persons abused the informant's son, dragged him from the shop and assaulted when the informant along with his daughter went to rescue then they were also assaulted and abused by calling the caste name, thereafter co accused Ghanshyam Yadav took away rupee three
Patna High Court Cr.Misc. No.33650 of 2015 (2) dt.13-08-2015 2/2 thousand five hundred from cash box of the shop. It is submitted by the learned counsel for the petitioners that omnibus and general accusation has been levelled and the injury has been found to be superficial in nature. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Bihariganj P.S. Case No. 69 of 2015 pending in the court of learned JM Ist Class, Udakishunganj (Madhepura).
This application is disposed of with the aforesaid observation/direction.
