Petitioner is languishing in custody in connection with Mohiuddin Nagar P.S. Case No. 231 of 2016 for the offences punishable under Sections 30/38 of the Bihar Prohibition and Excise Act, 2016.

The petitioner has stated in para-3 of the bail petition that he has got no criminal antecedent whereas the case diary reveals that the petitioner is accused in Mohiuddin Nagar P.S. Case No.223 of 2016.

Considering the aforesaid suppression of fact by the petitioner, without going into the merit of this case, I am not inclined to enlarge the petitioner on bail. The prayer for bail of

Patna High Court Cr.Misc. No.8567 of 2017 (3) dt.19-04-2017 2/2 the petitioner is refused. The petitioner may renew the prayer after six months from today disclosing his entire criminal antecedent. (Birendra Kumar, J) Mkr./- U T
