The Petitioner seeks bail in Nardiganj P.S.
Case No. 46 of 2016, pending in the Court of learned Chief Judicial Magistrate, Nawada instituted for the offence under Section(s) 302 of the Indian Penal Code.
The petitioner is the main assailant. It is alleged that he assaulted the husband of the informant by brick, on account of which he became unconscious and later on died. The doctor has found in the postmortem report, fracture of parietal bone and opined that the death occurred on account of the aforesaid three injuries, caused by hard and blunt object on head. In such circumstance, this Court is not inclined
Patna High Court Cr.Misc. No.5846 of 2017 (3) dt.30-03-2017 2/2 to grant bail to the petitioner. The prayer of the petitioner for bail is rejected at this stage.
However, the petitioner may renew his prayer for bail after nine months if no substantive progress is made in the trial.
