.... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Raghav Prasad For the Opposite Party/s : Mr. Sri Manish Kumar 2 ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-02-2017 Heard the parties.

This application is for grant of bail in connection with Maharajganj P.S.Case No.191 of 2016 for the offence under Sections 385, 387/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that though the allegation as made in the F.I.R. is absolutely unbelievable as nobody will take "Rangdari" at the Platform and he is in custody for about five months.

Heard learned A.P.P. also, who has opposed the prayer for bail stating that there is clear allegation against the petitioner and the petitioner has criminal antecedent and in one another case of similar nature, he is accused.

Having heard both sides. In view of the fact that there is

Patna High Court Cr.Misc. No.3200 of 2017 (4) dt.16-02-2017 2/2 direct allegation as well as the fact that there is one more case of the similar nature against the petitioner, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail before the court concerned itself and the learned court below will pass appropriate order without being prejudiced by the order of this Court.. With the aforesaid observation, this application is dismissed.
