Petitioner is apprehending his arrest in connection with Kudhani P.S.Case No.415 of 2016 , registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a), 36 and 38 of the Bihar Prohibition and Excise Act.
As per FIR it is alleged that the petitioner and other accused persons are engaged in liquor business and from the other co-accused persons there is recovery of liquor also. Submission of the learned counsel for the petitioner is that even according to the FIR there is no recovery from his house or from the conscious possession or at his instance rather he has been made accused only on information by the
Patna High Court CR. MISC. No.56447 of 2019(3) dt.16-11-2019 2/2 police but no source of information has been mentioned and even during the investigation nothing has come except the above fact.
Heard learned A.P.P. , who could not controverted the above fact..
Having heard both sides and in spite of the above fact that the case diary has been received, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Muzaffarpur in connection with Kudhani P.S.case No.415 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
