Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 379, 420 of the Indian Penal Code read with Section 66(c) of the I.T. Act. Learned counsel for the petitioner submits that the petitioner is in custody since 01.10.2021, charge-sheet has been submitted, is a person with clean antecedent and is a student, in support of which a supplementary affidavit has been filed bringing on record the certificate issued by the Secondary Board and College in favour of the petitioner as Annexure-2 series. The informant alleges that one Randeep Singh committed fraud with him and withdrew Rs.97,672/- from his SBI Account after obtaining his QR Code in the name of depositing the rent. The

Patna High Court CR. MISC. No.71216 of 2021(3) dt.12-05-2022 2/2 informant further alleges that petitioner along with other named accused persons also connived with him in committing the fraud. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and the petitioner is a student and was completely unaware that as to how the said money came in his account. Learned counsel further submits that the moment the money came in the account of the petitioner, the same was withdrawn at Noida (U.P.) and the QR Code was given to Randeep Singh and it appears that he committed the said fraud by transferring the amount in the account of the petitioner. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 01.10.2021, charge-sheet has been submitted, is a person with clean antecedent and is a student, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kudra P.S.
