This application is for grant of bail in connection with Kotwali (Barari) P.S.Case No.680 of 2016 for the offence under Sections 30(a) and 38 of the Bihar Excise Act. It is submitted on behalf of the petitioner that he is Driver of the Vehicle and not owner and he had no knowledge about the seized articles from before. He has clean antecedent and he is in custody for about three months.

Heard learned A.P.P. also.

Having heard both sides and from perusal of the record, it appears that there is recovery of huge quantity of liquor from the Vehicle, which was driven by the petitioner, as such I am not inclined to grant bail to the petitioner, however, considering the

No.14521 of 2017 (2) dt.29-03-2017 2/2 fact that he is in custody, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer for bail before the court concerned. With the aforesaid observation, this application is dismissed.
