JUSTICE SANJAY PRIYA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in K. Nagar P.S. Case No. 389 of 2016 instituted for the offence under Section 394 and 411 of the Indian Penal Code.

It is alleged that four miscreants intercepted the motorcycle of the informant and snatched an amount of Rs. 61000/-, ATM and Aadhar cards etc.

The learned Sessions Judge has mentioned in the impugned order that the name of this petitioner has been disclosed in the confessional statement of Kundan Kumar. It has been submitted that Rs. 4000/- was recovered from the possession of co-accused Gaurav Kumar, which would be evident from perusal of the written report itself.

Misc. No. 6401 of Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Nagar P.S. Case No. 389 of 2016 , subject to the condition that both the bailors will be the close relatives of the petitioner.
