The petitioner has prayed for bail in a case registered for the offence punishable under sections 498A, 323, 324, 307/34 of the Indian Penal Code and section 3⁄4 of the Dowry Act.

As per allegation in the FIR, petitioner along with his family members has tortured in various ways to the informant due to non-fulfillment of additional dowry demand. Specific allegation against the petitioner is that he has inflicted know blow upon the informant as a result of which she received cut injury in her wrist.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.62627 of 2023(2) dt.05-10-2023 2/2 has submitted that petitioner is nephew of the informant's husband. Marriage of the informant took place 15 years ago. Petitioner is a student has been falsely implicated in this case. Injured has received cut injury in her hand, which is not a vital part. The sole responsibility to take care of wife is upon husband and not against his family members. Petitioner is living separately from the informant and her husband. Petitioner is languishing in judicial custody since 3.8.2023. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Darbhanga in connection with Darbhanga Mahila PS Case No. 25 of 2023.
