Petitioner has approached this Court for a direction to the respondents to pay salary for the period 11.11.2013 to till date.

It appears from the counter affidavit that the petitioner has procured appointment on the basis of forged certificate Annexure-D of the counter affidavit is a show cause notice to the petitioner wherein the District Programme Officer (Establishment), Buxar has asked to petitioner to explain his conduct with regard to use of forged certificate.

Patna High Court CWJC No.14345 of 2016(4) dt.05-08-2019 2/2 Learned counsel for the petitioner submits that till date there is no finding as to use and forged certificate in procuring appointment by the petitioner.

Considering the aforesaid, the writ petition is disposed of with a direction to the respondents to take appropriate final decision with regard to the show cause notice Annexure-D and after enquiry if it is found that the petitioner was appointed on the basis of forged certificate then no relief is admissible to the petitioner. If on enquiry the respondent District Programme Officer finds the certificate of the petitioner is genuine he shall ensure payment of salary for the period petitioner has worked. Necessary decision after enquiry shall be taken by the respondents within a period of three months from the date of receipt/production of copy of this order.

With the aforesaid, the present writ petition stands disposed.
