2. The petitioner seeks regular bail in connection with Gaura P.S. Case No. 150 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act.
3. On secret information, police conducted raid at the marked place and recovered 31.460 litres of illicit liquor. Petitioner was apprehended on the spot.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Recovery has been made from the under construction house of the petitioner. Petitioner has no concern with the seized liquor. Petitioner is a young boy having clean antecedent. He is in custody since 02.08.2025. Petitioner undertakes to co-operate
Patna High Court CR. MISC. No.59255 of 2025(3) dt.10-10-2025 2/2 in the trial. Similarly situated co-accused has been granted bail by this Court, vide order dated 11.09.2025 passed in Cr. Misc. No. 59345 of 2025.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Judge, Saran at Chapra in connection with Gaura P.S. Case No. 150 of 2025. (Sunil Dutta Mishra, J) rakhi/- U T
