JUSTICE ANIL KUMAR SINHA ORAL ORDER 25-11-2022 Learned counsel for the petitioner submits that the present application has been filed challenging the interim maintenance awarded by the Principal Judge, Family Court, Purnea vide order dated 27.07.2018 passed in Maintenance Case No. 38/2015.

He next submits that subsequently, during pendency of this application, order of final maintenance has been passed in the aforesaid proceeding by the Family Court which has separately been challenged by the petitioner in Misc. Appeal No. 662/2019.

Accordingly, he seeks permission to withdraw this

Patna High Court C.Misc. No.765 of 2022(2) dt.25-11-2022 2/2 petition with liberty to challenge the order impugned of interim maintenance, if required, in the aforesaid Misc. Appeal No. 662/2019.

Permission is granted.

Petition stands dismissed as withdrawn with the aforesaid liberty.
