The petitioner is aggrieved by the encroachment of 5 ft. road by Respondent no. 8, which was left by the vendor of the petitioner on Survey Plot No. 174, Khata No. 128 and Plot No. 233 Khata No. 107, Municipal Survey Plot No. 2764 and 2765.

It appears from the pleadings of the writ application that the petitioner has submitted a representation before the

Patna High Court CWJC No.10811 of 2018(2) dt.22-06-2018 2/2 Respondent no. 3, Commissioner, Patna Municipal Corporation, Patna on 1.11.2017 and 31.3.2018, as contained in Annexures 4 and 5.

Mr. Prasoon Sinha, learned counsel for the Patna Municipal Corporation submits that at present he is not having any instruction. However, if the representation of the petitioner has not been disposed of, it will be disposed of within a time frame.

Keeping in view the nature of issue involved in the present writ application and the representations of the petitioner as contained in Annexures 4 and 5 being pending, it is expected from the Respondent no. 3, Commissioner, Patna Municipal Corporation, Patna to dispose of the representation of the petitioner, preferably within a period of six weeks from the date of receipt/production of a copy of this order.
