JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-401, 413, 414, 34 of the Indian Penal Code. One motorcycle, some foreign currency, diary etc. are said to have been recovered from conscious possession of the petitioner whereas; two separate motorcycles were recovered from possession of other accused.

Submission on behalf of petitioner is that petitioner happens to be motor mechanic and as a matter of fact, nothing was recovered from conscious possession of the petitioner and police implicated the petitioner not only in the present case but in several

Patna High Court Cr.Misc. No.40325 of 2016 (3) dt.21-11-2016 2/2 other cases also. It is further submitted that the petitioner is in jail custody since 10-02-2016 and the investigation against him has already been completed.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mehshi P.S. Case No. 21 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Motihari, East Champaran.
