The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 279/337/354B of the Indian Penal Code and 12 the Protection of Children from Sexual Offences Act, 2012.
It is alleged that while the informant was going to coaching instituted this petitioner dashed her by his auto rickshaw, consequently, the informant fell down when she made protest then the petitioner misbehaved with her. It is submitted by learned counsel for the petitioner that for the occurrence of 01.07.2014, the FIR was registered on 05.07.2014 and prior to the present occurrence; the maternal uncle of the petitioner was also made accused by the mother of
Patna High Court Cr.Misc. No.38685 of 2014 (3) dt.01-05-2015 2/2 the informant being Gaya SC/ST P.S. Case No. 42 of 2014. In fact, when father of the informant and others not vacating the purchased land of the maternal uncle of the petitioner, the case was registered before the Gram Kachahari and the order was passed against informant's father. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Bodhgaya P.S. Case No.190 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
