The petitioner apprehends his arrest in Rajnagar P.S. case No. 200 of 2016 under Section 7 of the E. C. Act. 127 bags of rice and 35 bags of paddy were recovered from the shop of the petitioner.

The learned counsel for the petitioner submits that petitioner is not a P.D.S. dealer and he purchases rice and paddy in open market from the farmers and only some of rice and paddy were kept in bags of BSFC and it cannot be said that the rice and paddy are subsidized items.

Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt

Patna High Court Cr.Misc. No.10490 of 2017 (2) dt.15-03-2017 2/2 / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Madhubani in Rajnagar P.S.
