2. The petitioner is in custody in connection with Shikarpur P.S Case No. 598 of 2023 registered for the offences punishable under Sections 147, 148, 149, 447, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code and Section 27, 25 (1-B)A, 26, 30 and 35 of the Arms Act.

3. As per allegation in the FIR, allegation against the petitioner along with other co-accused persons is to have caused fire-arm injuries to the informant and his brothers. It is further alleged that this petitioner caused death of the cousin brother of the informant, namely, Iliyas Shiek by means of firearm.

4. Earlier the prayer of bail of the petitioner was rejected vide order dated 18.10.2024 in Cr. Misc. No. 28397 of 2024. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is also submitted that petitioner is in judicial custody since 18.07.2023 having one criminal antecedent.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. Considering the submission made by learned counsel for the petitioner and the materials available on record, it appears that there is specific allegation as regard to causing firearm injury upon the deceased, Iliyas against this petitioner and as postmortem report also supports the version of FIR and the statement of witnesses, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
