JUSTICE SANJAY KUMAR ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

The petitioner seeks regular bail in connection with Ganga Bridge P.S. Case No. 56 of 2016 registered for the offences punishable under Sections 8/20 (b)(ii) (c)/25/29 of the NDPS Act.

The SHO of Ganga Bridge Police Station, on secret information, reached at the place of occurrence and apprehended two vehicles. The petitioner was found travelling in pick up van and from the said van police seized 280 kg. Ganja in 19 packets. The occupant of another vehicle escaped leaving the vehicle from which 20 kg. Ganja was recovered.

Patna High Court Cr.Misc. No.5879 of 2017 (2) dt.15-02-2017 2/2 Learned counsel for the petitioner submits that he has no concern with the vehicle in question or the alleged recovery. He is a student and has falsely been implicated in this case. It has also been submitted that the said vehicle was caught at 3 A.M., however, the seizure list was prepared at 5.30 A.M. The petitioner has been falsely implicated with oblique motive. Learned APP for the State opposed the submission. Considering the recovery of 280 kg. of Ganja from the vehicle of the petitioner as also the fact that the seizure was made in his presence as well as presence of two local independent witness, who have put their signature on seizure list, I am not inclined to grant him bail. The prayer is accordingly rejected.
