Case No. 72 of 2019, registered for the offences punishable under Sections 363, 365 and 366A of the Indian Penal Code. Allegation against the petitioner is that he along with others kidnapped the victim girl and taken her to Delhi and kept her in a room and there is also allegation that they tried to sell her.

Submission of learned counsel for the petitioner is that as a matter of fact this is a case of love affair and conduct of the victim girl also disclosed that she is a consenting party and no force was used on her and even there is no allegation of commission of rape or any overt act against him and report of Medical Board suggests that she was aged 17-18 years and he is in custody since 16.4.2019.

Considering the submission made above, let the petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Smt. Tanveer Kaur, Judicial Magistrate, 1st Class, Patna, in connection with Hawai Adda P.S. Case No. 72 of 2019.
