JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-02-2017 The petitioner, who is the husband of Opposite Party No. 2, has been asked to pay monthly maintenance allowance, under Section 125 of the Code of Criminal Procedure, 1973, at the rate of Rs. 3,000/-, by the impugned order, dated 09.07.2014, passed by the learned Principal Judge, Family Court, Aurangabad, in Misc. Case No. 76 of 2011.
I have perused the impugned order and other materials on record.
I do not find any perversity in the findings recorded by the learned Court below as regards petitioner's income. In that circumstance, the amount awarded by the learned Court below of Rs. 3,000/- per
Patna High Court CR. REV. No.867 of 2014 (3) dt.09-02-2017 2/2 month, as maintenance allowance, does not appear to be excessive, requiring interference in criminal revision jurisdiction.
This application has no merit and is, accordingly, dismissed.
