This is an application for bail in connection with Fatehpur P.S.Case No. 257 of 2016 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47(a)(g) and 50 of Bihar Excise Amendment Act, 2016. It has been submitted on behalf of the petitioner that there is alleged recovery of 164 bottles of foreign liquor from two accused persons and he is in custody since 25.1.2017 and he has been made accused in other case of similar type but he is on bail in that case.

Heard learned APP also, who has opposed the prayer for bail stating that there is recovery of huge quantity of liquor. Having heard both sides and considering the facts and

Patna High Court Cr.Misc. No.10215 of 2017 (3) dt.07-04-2017 2/2 circumstances, as stated above, and as he is an accused in similar type of case, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.

However, learned trial court is directed to expedite the trial and try to conclude it within a period of six months. Accordingly, this application is dismissed.
