JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by this Court but petitioner is in jail custody since 23.03.2013 on the accusation that one bhala is said to have been recovered from his house and petitioner had been identified by the witness in Test Identification Parade.

Learned counsel for the petitioner submits that the Test Identification Parade was held after long gap and moreover, up till now, not a single prosecution witness could be examined in this case.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.38948 of 2015 (2) dt.04-11-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-XI, Motihari in connection with Sessions Trial No. 77 of 2015 arising out of Chiraiya P.S. Case No. 81 of 2013.
