2. After some argument, learned Counsel for the petitioners submit that in view of the stand of the State that against the order passed by the Circle Officer, they should have preferred appeal instead of invoking the writ jurisdiction, he shall be filing an appeal.

3. The petitioners has the liberty to challenge the order of the Circle Officer in appeal. If the same is filed within a

Patna High Court CWJC No.20847 of 2021(6) dt.22-03-2024 2/2 period of eight weeks from today before the Collector, Muzaffarpur, he shall take into account the facts that the writ petition was pending before this Court since the year 2021 while deciding the limitation petition for condonation of delay.

4. The interim order dated 27.07.2022 stands vacated.
