JUSTICE BIRENDRA KUMAR ORAL ORDER 27-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 364 of the Indian Penal Code. The FIR is against unknown with allegation of kidnapping of Manoj Kumar Mandal, son of the informant. The victim boy in his statement under Section 161 Cr.P.C. before the police has not leveled any allegation against this petitioner. Similarly situated co-accused Kamala Kant Singh @ Dhaba Singh has already been allowed bail by a co-ordinate Bench of this Court by order dated 16.03.2017 passed in Cr. Misc. No.3803 of 2017. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-

Patna High Court Cr.Misc. No.5967 of 2017 (3) dt.27-03-2017 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Jamui/Successor Court, in connection with Laxmipur P.S. Case No.132 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
