JUSTICE BIRENDRA KUMAR ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Section 30(g) of the Bihar Excise (Amendment) Act, 2016.

80 liters toddy was recovered from the verandah of the house of this petitioner. Petitioner has stated on oath that he has got no criminal antecedent and he is in judicial custody since 11.01.2017.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail, after completion of four months in custody, on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court Cr.Misc. No.10502 of 2017 (3) dt.28-03-2017 learned Chief Judicial Magistrate, Muzaffarpur/Successor Court, in connection with Excise Case No.15 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
