JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 429 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that the pig of the informant went to the water pit of the petitioner getting avoid with the same, the petitioner pierced iron rod in the abdomen of the pig. It is submitted by learned counsel for the petitioner that maliciously the present accusation has been levelled. For the occurrence of 19.05.2015, the FIR was lodged 20.05.2015. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Certified copy of seizure list has been produced by the
Patna High Court Cr.Misc. No.34091 of 2015 (2) dt.25-08-2015 2/2 learned counsel for the informant, which shows seizure of old iron rod only. Let the same is taken on record.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Danapur in connection with Bihta P.S. Case No.371 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
