2. Petitioner seeks regular bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Amendment Act.

3 . As per the prosecution case, 150.840 litres English liquor was recovered from motorcycle in question .

4. Learned counsel for the petitioner submits that petitioner is neither owner nor driver of the vehicle in question . No incriminating material has been recovered from conscious possession of the petitioner and he has been made accused only on suspicion . Petitioner is in custody since 09.08.2024 . 5 . Learned A.P.P. for the State vehemently opposed the bail application .

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Subordinate Court of learned Special Judge Excise - II, Samastipur in connection with Waini P. S. Case No. 04 of 2024 .
