The petitioner seeks bail in Harlakhi P.S. Case No. 245/2016, registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged that one gunny bag containing country made liquor and the motorcycle were recovered. The petitioner was not arrested on the spot but the Chaukidar is said to have disclosed the name of the petitioner as the person who was carrying gunny bag on the motorcycle. Sixty six litres of country made liquor was recovered from the bag. The petitioner does not claim the motorcycle to be his own. The petitioner is in jail since 11.01.2017. He has already remained in jail for two months.
Patna High Court Cr.Misc. No.11201 of 2017 (2) dt.10-03-2017 2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Benipatti, Madhubani in connection with Harlakhi P.S. No. 245/2016.
