====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-04-2025 Petition for pre-arrest bail of petitioners no. 2, 3 and 4 is dismissed as withdrawn.

2. Heard learned counsel for petitioner no. 1 and the State.

3. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.

4. As per the prosecution case, while the informant was returning to his house, all the FIR named accused persons including these petitioners assaulted him with farsa causing him injuries.

5. Learned counsel appearing for petitioner no.1 submits that no specific overt act has been alleged against petitioner no.1, and at best he can be said to be a member of mob. Police, during investigation, did not find any material against the petitioner and did not send him for trial. However, court below differing with the same took cognizance of the offence against the petitioner also. Informant and co-accused Sakoor are own brothers and are having land dispute. There is case and counter case.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner no. 1 is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner no. 1, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Bounsi Police Station Case No. 117 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
