2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 302, 201 and 34 of the Indian Penal Code, registered in connection with Motipur P.S.Case No. 296 of 2023.

3. According to allegation, the accused persons including the petitioner, who is husband of the deceased, committed her murder and cremated her dead-body.

4. The learned counsel for the petitioner has submitted that the death of the deceased occurred after seven years of marriage. There is no allegation of demand of dowry. It has further been submitted that in para-33 and 34 of the case diary, the independent witnesses have stated that the husband

Patna High Court CR. MISC. No.58834 of 2025(4) dt.10-10-2025 2/2 and wife used to quarrel and the wife (the deceased) had threatened the petitioner to implicate him in false case after consuming poisonous substance. The petitioner is in custody since 27.11.2024 and not a single witness has been examined till date according to the report of the trial court dated 2509.2025.

5. On the other hand, Mr. Shailendra Kumar, the learned APP for the State, has opposed the prayer for bail.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Muzaffarpur (West) or successor court in in connection with Motipur P.S.Case No. 296 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
