The petitioner is accused in connection with Gopalpur P.S. Case No. 376 of 2008 (S.T. No. 670A of 2010), registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of Additional Sessions Judge-I, Naugachia, Bhagalpur.

The accusation is that five persons named in the F.I.R. including the petitioner surrounded to Bhuneshwar Yadav, husband of the informant. At that time, this petitioner shot fire at the head of husband of the informant whereas Ranjit Mandal caused firearm injury at the head of husband of informant and Mantu Mandal also caused injury through axe at the head husband

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to land dispute and he is in custody since 05.08.2016. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for bail stands rejected.
